Commercial Disputes

We at AH2 Legal frequently handle commercial disputes concerning a wide variety of disputes in a commercial context.

These types of disputes usually comprise of one or more of the following:

  • Misleading or deceptive conduct;
  • Disputes between shareholders;
  • Partnership disputes;
  • Breaches of contract;
  • Money owed; or
  • Disputes about property ownership.

Often times, these commercial disputes are resolved or settled out of Court without the need for any commercial litigation. AH2 Legal have experienced commercial litigation lawyers who practice exclusively in this complex area of commercial disputes. We have resolved hundreds of disagreements between disputing parties through our extensive understanding of the types of issues that can arise, and the best means of commercial dispute resolution.

Trust Disputes

Trusts are frequently used in estate planning, superannuation funds, family businesses and commercial activities. We at AH2 Legal have extensive experience in handling various Trust disputes in a commercial context.

The nature of the relationship between trustees and beneficiaries can cause a variety of disputes. In a Trust, the Trustee is responsible for holding Trust assets and must ensure that they administer the Trust appropriately. The beneficiaries in a Trust are ultimately entitled to the benefit of the Trust assets, and as a result, beneficiaries usually scrutinise the Trustee’s conduct carefully to ensure that their benefits are not infringed upon.

Over the years, we have assisted clients in situations where a Trustee has:

  • refused to provide Trust documents to beneficiaries (such as the Trust deed, tax returns and financial statements);
  • not exercised its discretions properly;
  • not followed the Trust deed;
  • acted in bad faith;
  • engaged in wrongdoing, misconduct, deceit, or fraud; or
  • improperly sold, transferred, used, or devalued Trust assets.

We can also assist in:

  • investigating suspected Trust mismanagement;
  • challenging the validity of a Trust;
  • advising a beneficiary of their rights under any Trust deed;
  • advising an appointor how to lawfully add or remove a Trustee from a Trust;
  • advising a Trustee of their duties, powers, rights and potential conflicts of interest; and
  • amending a trust deed or terminating a Trust.
