Who can make a claim?

If you were injured in a motor vehicle crash or financially dependent on the person fatally injured in a motor vehicle crash, you may be able to make a claim. In order to make a claim, you must be able to establish that the driver or owner of a motor vehicle was at fault, whether completely or in part. You may still be able to claim even if you don’t know who caused the accident (e.g.: a hit and run accident). However, you must have taken reasonable steps to find out who caused the accident.

How do I make a claim?

If you are injured in a crash, are able to establish another driver was at fault, and wish to make a claim, you should contact the Insurance Commission of Western Australia notifying them of your intention to make a claim. The Insurance Commission of Western Australia manages all personal and fatal injury claims resulting from motor vehicle crashes that involve Western Australian licensed vehicles. This means the injured person makes a claim against the Insurance Commission of Western Australia, rather than against the driver and/or owner who caused the injuries.

What can I claim?

If you are injured in a motor vehicle accident, you can claim compensation for:

  • past and future economic loss;
  • pain and suffering;
  • loss of amenities of life;
  • loss of enjoyment of life;
  • past and future medical expenses; and
  • household support services.
